If you’re an injured worker who disagrees with the opinion of a WCB
physician because it’s medically inaccurate, or it’s based on erroneous and/or incomplete information, you should
consider taking the following steps:
- Write a letter to the WCB physician
and present your concerns in a clear and concise manner, and provide all medical information supporting your position. Note:
Never assume that a WCB physician reviews all medical information submitted by your doctors. WCB will often withhold certain
medical information from their physician in order to obtain the opinion they want. If the WCB physician has not acknowledged,
or commented on your doctor’s reports, chances are this physician did not receive/review them.
- In
your letter, be sure to request that the WCB physician respond to your family doctor, as this physician is not likely to respond
directly to you.
- Be sure to send your letter by registered mail, ensuring that it’s addressed specifically to the
attention of the WCB physician, and that his/her signature is required upon receipt of it.
It’s important to
point out that all physicians are entitled to their own opinion. However, if that opinion is baseless, or there is any sort
of misconduct associated with it, you have grounds for filing a complaint with The College of Physicians and Surgeons in your
province.
If the response you receive
from the WCB physician can be likened to that described above, or this physician simply refuses to respond to your concerns,
I strongly urge you file a complaint against him/her with the College. Please know that such a complaint could result in a
revision of that physician’s opinion, or the exclusion of it from your WCB file.
